The “ Comstockery ” of Justice Clarence Thomas
BY MIKE MAGEE “When we think about the past, we think about history. When we think about the future, we think about science. Science builds upon the past, but also simultaneously denies it.” These are the words of Jim Secord, a Professor of History and Philosophy of Science at the University of Cambridge. His research and teaching are on the history of science from the late eighteenth century to the present, with a special focus on Darwinian evolution.  His perspective is especially relevant when it comes to the recent Dobbs decision. The history of this contemporary struggle is as clear ...

Some States Are Fighting in Court to Increase Illegal Immigration
David J. BierI havean op ‐ed in the Daily Beast that helps illuminate both the politics and the causes of the large numbers of illegal crossings at the U.S.-Mexico border.A coalition of Republican ‐led statesis asking a  district court to consider whether the Biden administration should be held in contempt of court for violating an order requiring it to expel undocumented immigrants at the U.S.-Mexico border. The supposed offense? Letting Haitian immigrants enter the country legally. The effort shows the states are not interested in solving illegal immigration, but rather, keeping immigrants out of the country en...

Promises Made – Promises Kept:   President Biden’s Support for “Obamacare.”
BY MIKE MAGEE As the saying goes, “History repeats!” This is especially true where politics are involved.  Consider for example the past three decades in health care. It is striking how many of the players in our nation’s health policy drama remain front and center. And that includes President Biden who recently commented on the 12th anniversary of the passage of the Affordable Care Act (Obamacare):  “The ACA delivered quality, affordable health coverage to more than 30 million Americans — giving families the freedom and confidence to pursue their dreams without the fear that one accident or il...

Border Wall Breaches Reach New Highs Despite Trump Wall
David J. BierPresident Trump promised an “impenetrable” border wall. Trump built (with some help from Biden) about 450 miles of his wall, accounting for two-thirds of the border fence, and the remaining sections are more recent designs that the Trump administration left because it largely approved of them.Despite the construction of these exceedingly expensive new barriers, crossers are breaching the border wall more frequently than before, according to data obtained by the Cato Institute through a recent Freedom of Information Act request. Based on the first half of fiscal year 2022, the border wall was on pace for 3,...

Can I Just Say I Find This Sort Of Attempted Cultural Imperialism Pretty Annoying!

DOL ’s New H‑2A Final Rule Will Increase Food Inflation
David J. BierThe Department of Labor (DOL) published a  new final rule this week that will change its process for certifying U.S. farmers to hire foreign guest workers under the H ‑2A visa category. DOL initiallyproposed the rule in 2019 under the Trump administration, but the proposed rule contained a  variety of cost‐saving and streamlining measures for employers. The Biden DOL went line‐by‐line removing all those positive aspects leaving only the cost‐increasing parts. This new rule will add to the already sky ‐rocketing food prices in the United States. In September, food prices had already ...

The college football fans that beat COVID and the experts that couldn ’t
BY ANISH KOKA The COVID pandemic was supposed to herald the end of the idea that a smaller government is a better government. The experts who desperately seek to be in charge of a sprawling bureaucratic state told us that it was only a powerful central authority that could do what was needed to safeguard individual liberties at a time when a highly contagious respiratory virus was spreading across the globe. New Zealand may have imposed draconian policies that did not even allow its own citizens to return, but scenes of cheering unmasked New Zealanders stood in sharp contrast to empty seats in American stadiums when ...

Truth and Trust in Science: Are They Negotiable?
BY MIKE MAGEE “The key is trust. It is when people feel totally alienated and isolated that the society breaks down. Telling the truth is what held society together.” Those words were voiced sixteen years ago in Washington, D.C. It was October 17, 2006. The HHS/CDC sponsored workshop that day was titled “Pandemic Influenza – Past, Present, Future: Communicating Today Based on the Lessons from the 1918-1919 Influenza Pandemic.” The speaker responsible for the quote above was writer/historian and Johns Hopkins School of Public Health adviser, John M. Barry. His opening quote from George Bernard Shaw se...

Commentators and Journalists Weigh In On Digital Health And Related Privacy, Safety, Social Media And Security Matters. Lots Of Interesting Perspectives - September 27, 2022.
Conclusions:This study revealed strong and consistent patterns of association between digital health literacy and the use of a web-based PHR. The results indicate potential actions for promoting PHR uptake, including improving digital technology and skill experiences that may improve digital health literacy and willingness to engage in web-based PHR. Uptake may also be improved through more responsive digital services, strengthened health care, and better social support. A holistic approach, including targeted solutions, is needed to ensure that web-based PHR can realize its full potential to help reduce health inequities....

Lofgren, Cheney Introduce Bill to Reform the Electoral Count Act
ConclusionOn the whole, both versions of ECA reform represent thoughtful, carefully considered attempts to answer some very complex constitutional and practical questions. While my purpose here is to analyze the policy merits and not the political path forward, the widely shared presumption is that ECRA, with its broader bipartisan support in the Senate, is likely to be the vehicle that ultimately moves towards passage. But the timing of PERA ’s introduction and possible passage by the House presents a good opportunity for the Senate to adopt some of its most important contributions when ECRA receives its committee markup...

Fentanyl Is Smuggled for U.S. Citizens By U.S. Citizens, Not Asylum Seekers
ConclusionBorder enforcement will not stop fentanyl smuggling. Border Patrol ' s experience with marijuana smuggling may provide even clearer evidence for this fact. Marijuana is the bulkiest and easiest-to-detect drug, which is why it was largely trafficked between ports of entry. Despite doubling the Border Patrol and building a border fence in the 2000s in part to combat the trade, the only thing that actually reduced marijuana smugglingwas U.S. states legalizing marijuana. It is absurd to believe that interdiction will be more effective against a drug that is orders of magnitude more difficult to detect. The DEA plainly...
