Panel: Groundwater Case Valid; Agency's Dismissal Argument Without Merit

HARRISBURG, Pa. - In an unpublished opinion, a panel of the Pennsylvania Commonwealth Court on July 25 denied the Pennsylvania Department of Environmental Protection's (DEP) motion to dismiss a groundwater contamination case brought by advocates for the environment, ruling that the plaintiffs had alleged sufficient facts and that the DEP's argument that the court lacked jurisdiction was without merit (Delaware Riverkeeper Network, et al. v. Pennsylvania Department of Environmental Protection, No. 525MD2017, Pa. Cmwlth.; 2017 Pa. Commw. Unpub. LEXIS 404).
