Plaintiffs Sufficiently Allege Injury In Contamination Lawsuit, Judge Says

HUNTINGTON, W.Va. - A federal judge in West Virginia on May 5 denied a motion to dismiss a groundwater contamination lawsuit against a railroad company and its contractor, concluding that the plaintiffs had sufficiently alleged special injuries as a result of an oil spill involving the defendants' derailed train (Brandy Sigman v. CSX Corporation, et al., No. 15-13328, S.D. W.Va.; 2016 U.S. Dist. LEXIS 60718).
