Motion To Dismiss Claims For Noise Injury Opposed In Pipeline Compressor Suit

PITTSBURGH - The motion to dismiss for failing to state a claim filed in August in the U.S. District Court for the Western District of Pennsylvania by the owner-operator of a Fayette County, Pa., natural gas pipeline compression station sued for allegedly exposing a neighbor of the compression station to noise from the station sufficient to cause permanent hearing loss and tinnitus should be denied because the defendant misconstrues the claims, the plaintiff avers in a response filed Sept. 12 (Thomas Koziel v. Texas Eastern Transmission, et al., No. 13-1197, W.D. Pa.; See 9/4/13, Page 25).
