Judge: Lead Plaintiffs' Duty Of Care Claim Fails, But Negligence Issues Remain

MILWAUKEE - A federal judge in Wisconsin on Sept. 12 partially granted and partially denied summary judgment motions by paint manufacturers that are defendants in a lead-paint poisoning lawsuit, ruling that the defendants did not owe a duty of care to warn the plaintiffs directly of the risks associated with residential lead paint, but also concluding that the plaintiffs could pursue negligence claims (Glenn Burton v. American Cyanamid, et al., No. 07-0303, E.D. Wis.).
