City Says Groundwater Class Action Should Be Dismissed; Open Dumping Claim Fails

FORT MYERS, Fla. - The city of Fort Myers on June 21 filed a brief in Florida federal court contending that a putative class action for the contamination of local groundwater with arsenic should be dismissed because the plaintiffs' open dumping claim predates federal law and "fails to acknowledge actionable conduct under applicable statutory and regulatory provisions" (Deretha Miller, et al. v. Fort Myers, et al., No. 18-195, M.D. Fla.).
