Liability of doctors based on negligence for culpable homicide: No need to change the law concerning medical negligence or to establish special medical malpractice courts - use mediation and medical assessors instead
S Afr Med J. 2022 Jan 27;112(3):216-218.ABSTRACTDoctors' organisations have called for special legislation regarding the criminal charging of doctors for culpable homicide, and the need for special medical malpractice courts to deal with the huge increase in the number of medical malpractice cases. However, there are very few criminal prosecutions, because the prosecuting authorities generally accept that doctors do not intend to kill their patients, and are only likely to charge them for intentional or very serious deviations from the standard of a reasonably competent doctor in their profession. Doctors are also generall...

Impressions of defensive medical practice and medical litigation among South African neurosurgeons.
Authors: Roytowski D, Smith TR, Fieggen AG, Taylor A Abstract From a litigation perspective, neurosurgery is considered a 'super high-risk' field, and this has been associated with rapidly increasing malpractice cover costs. In 2013 the annual Medical Protection Society fee for cover was R250,900. We wished to determine whether high malpractice cover was influencing how neurosurgeons managed patients. A 40-question online survey asking questions on defensive medicine was distributed to determine perceptions around liability risk and whether these influenced how patients were managed. Eighty-four per cent of respond...

SAMA pitches in to help victims of medical negligence.
Authors: Bateman C Abstract The South African Medical Association, (SAMA), is investigating setting up a fund to compensate patients who fall victim to unavoidable adverse events (through no fault of their treating physician), while working with government to improve the overall quality of care in both public and private sectors.SAMA Chairperson, Dr Mzukisi Grootboom, emphasized that this would in no way affect legitimate medical negligence claims but form part of an overall strategy to address a crisis that threatened the very existence of higher-risk specialist care in South Africa - something that would negative...

Traditional health practitioners and the authority to issue medical certificates.
Authors: Tshehla B Abstract The Interim Traditional Health Practitioners Council was inaugurated in February 2013 and in May 2014 the sections of the Traditional Health Practitioners Act that give it full powers came into effect. The Council, as a professional body established by Parliament, gives traditional health practitioners registered with it the authority to issue medical certificates in line with the provisions of the Basic Conditions of Employment Act. However, the Council does not seem to be in a position to perform this function yet. Moreover, the field itself seems almost impossible to regulate because ...

Focus areas of cardiovascular medical device research in South Africa.
Authors: Chimhundu C, De Jager K, Douglas T Abstract We investigated the focus of cardiovascular medical device research in South Africa over the 15-year period 2000 - 2014. Information drawn from journal articles was used for the analysis, with attention to articles describing a contribution to the development of a cardiovascular medical device, or a new application of an existing device. The findings suggest that research has focused on diagnostic and monitoring as well as prosthetic cardiovascular medical devices, with specific emphasis on vascular and valvular heart diseases.
