HHS: Safeguarding the Rights of Conscience as Protected by Federal Statutes

Notice of final rule from the U.S. Department of Health and Human Services (HHS) partially rescinding theMay 21, 2019, final rule, "Protecting Statutory Conscience Rights in Health Care; Delegations of Authority." The Department retains, with some modifications, certain provisions of the 2019 Final Rule regarding federal conscience protections but eliminates others because they are redundant or confusing, undermine the balance Congress struck between safeguarding conscience rights and protecting access to healthcare access, or because significant questions have been raised as to their legality. This rule leaves in effect the framework created by theFebruary 23, 2011, final rule. This rule is effective March 11, 2024.
