FDA's Last Licks for 2016: Issues SIX (6) Enforcement Letters in December, So Far!
Click on image for enlarged view.Just when you thought the FDA was finished issuingWarning andUntitled letters for 2016, it issued 2 more - both Untitled letters - last week, bringing the total issued in December to 6! The grand total to date is 11 letters, including 3 Warning letters.I suspect FDA is responding to critical posts such as the one I wrote on 8 December 2016 citing a total of only 8 letters up until that date. A week later I had to update that (here) when the total reached 9 letters for 2016. I characterized that as a"slight uptick" in enforcement compared to 2015 when FDA also issued 9 total letter...

FDA Cites TV Ads for " Compelling " " Attention-Grabbing " Distractions That Undermine Communication of Risks
According to anuntitled letter FDA recently sent to Sanofi, all the fast-paced"grooving" going on in the “Mr. Groove” TV ad (here) for Toujeo makes it"difficult for consumers to adequately process and comprehend the risk information. The overall effect undermines the communication of the important risk information and thereby misleadingly minimizes the risks associated with the use of Toujeo." Moreover,"the presentation in the video is especially problematic from a public health perspective given the serious and potentially life-threatening risks associated with the drug.""Mr. Groovr&...

21st Century Cures for Pharmaceutical Marketing
In what Public Citizen described as an"Early Gift for the Pharmaceutical Industry" (seehere), the Senate this week passed the 21st Century Cures Act (21st CC), which contains many provisions that will benefit the pharmaceutical industry and patients, according to many observers, including President Obama who said"We are now one step closer to ending cancer as we know it, unlocking cures for diseases like Alzheimer's..."The Act will also benefit pharma marketers and usher in a new era of pharmaceutical marketing. 2016 Sees a Slight Uptick in FDA ’s Enforcement Actions
UPDATED 15 December 2016: A few days ago, I reported that FDA continues to issue fewer and fewer warning and untitled letters. When I wrote that (8 December 2016) FDA had issued only 5 enforcement letters (4 untitled and 1 warning letter) compared to 9 letters in 2015.This week on 12 and 13 December, FDA issued 4 new letters - 2 warning letters and 2 untitled letters - to bring the total to 9 letters for 2016. As the revised chart on the left shows, this equals the number of total letters FDA sent last year but this year, to date, FDA issued one more warning letter than it did last year. So, this could be considered a " sl...

FDA ’s Lax Enforcement Trend Continues
FDA continues to issue fewer and fewer warning and untitled letters. As of today (8 December 2016) FDA has issued only 5 enforcement letters (4 untitled and 1 warning letter) compared to 9 letters in 2015.Perhaps in 2017 FDA will issue no letters at all, especially if Trump has his way and Silicon Valley investor Jim O ’Neill becomes the new FDA Commissioner. O’Neill is not a scientist or physician so it ' s no wonder that he has proposed that the FDA only require companies to prove drugs are safe before they are sold – not that they actually work (readthis). The other trend I see is FDA caving in to forces that oppos...

Can This Work for Pharma? The Continual Quest of Creative Advertisers
PM360 magazine is asking its readers find marketing campaigns and tactics used by consumer packaged goods, retail, and other industries to give pharma marketers some fresh ideas. Here's what one ad agency SVP Executive Creative Director came up with as and example of how pharma can"push the boundaries":Could This Work for Pharma? Inspiration from Outside Industries In terms of creepiness, this campaign has nothing over some creepy pharma campaigns I've seen (see, for example, my"Gallery of Scary Pharma Industry Advertising").According to the Creative Director who submitted this example to PM360,...

FDA Compliant Diclegis Instagram Promo by (Good) Emily Maynard Johnson Can't Compete with (Bad) Kim Kardashian's Violative Post
About 22 weeks ago, Emily Maynard Johnson, who appeared on ABC'sThe Bachelor and The Bachelorette, posted the following Diclegis promotion to her Instagram account:I assume you've noticed that all the ISI (Important Safety Information) and side effects are mentioned either through links or, more importantly, within the post itself (you have to scroll down to see it). This is in contrast to Kim Kardashian's Diclegis Instagram promotion that made news last year. That ad drew a prompt warning letter from the FDA to Duchesnay USA, which markets the drug, because the post did not mention nor did it link to any ISI or...
