EBSA: Definition of “Employer” Under Section 3(5) of ERISA-Association Health Plans

Proposed rule from the Employee Benefits Security Administration (EBSA) that would modify the definition of "employer" and broaden the criteria for determining when an employer may join together in a group or association that is treated as the sponsor of a "group health plan" or "employee welfare benefit plan." The goal of the proposed rule is to expand access to affordable health coverage by removing undue restrictions on association health plans and allowing the sale of health insurance across state lines. Comments regarding provisions of the proposed rule must be submitted on or before March 6, 2018.
