Supreme Court Treads Carefully in Gonzalez
Will DuffieldLast month the Supreme Court heard oralarguments inGonzalez v. Google, a case about whether Section 230 protects platforms from liability for algorithmically recommended speech. This is the first time the Court has heard a case involving Section 230, and a bad ruling wouldremake the internet for the worse. Although many had feared that justices would use the opportunity to get at Big Tech, the Court was skeptical of petitioners ' counsel Eric Schnapper ’s textual arguments and mindful of algorithms ' almost universal use in sorting information online.Going intoGonzalez, there wasn ’t a circuit split about a...

Details of 155 Immigration Detainers for U.S. Citizens
David J. BierImmigration and Customs Enforcement (ICE) routinely requests that local law enforcement detain U.S. citizens to allow it to pick them up. ICE ’s recordslist 3,158 U.S. citizens as targets of ICE detainers from October 2002 to September 2019. Another 1.6 percent of actual ICEarrests through Secure Communities —the targeting system that ICE uses to issue detainers—were U.S. citizens from October 2008 to April 2011—or 3,627 citizens. Immigration courts—again with incomplete records—show 2,549 removal proceedings terminated in the favor of U.S. citizens from 2002 to June 9, 2017.These totals undercount...

A Promising Hub For Digital Health: Kazakhstan
Sharing borders with Russia, China, Kyrgyzstan, Uzbekistan, and Turkmenistan, you find the world’s largest landlocked country, the Republic of Kazakhstan. Conversely, with its population of over 18 million spanning across an area of 2,724,900 km², the country also has one of the lowest population densities worldwide, at less than 6 people per square kilometre. Being a relatively new republic and with its widespread inhabitants, Kazakhstan poses as an adequate hub for digital health to expand. Such a young republic’s ministry of health can develop around newer technologies and strategies brought forth with the adven...

Profiles of Every Terrorism Vetting Failure in the Last 30 Years
In my newpolicy analysis released today, I identify 65 vetting failures where the visa vetting system allowed a foreign-born person to enter the United States as an adult or older teenager when they had already radicalized —80 percent occurred before 9/11. Just 13 vetting failures have occurred since 9/11, and only one—the last one (Tashfeen Malik)—resulted in any deaths in the United States. That’s one vetting failure for every 29 million visa or status approvals, and one deadly failure for every 379 million visa or status approvals from 2002 to 2016.As I note, 9/11 is reasonable point of analysis because after th...

Guide to the Diversity Visa: Demographics, Criminality, and Terrorism Risk
ConclusionThe diversity visa is a relatively small green card category that has allowed in about a million legal immigrant principals since 1993, or about 5 percent of the total.   As far as we know, immigrants who entered on the diversity visa are responsible for committing one terrorist attack on U.S. soil that murdered eight people.  Foreign-born people from countries that have sent many diversity visa immigrants to the United States have lower incarceration rates than native-born Americans.  Calls to end the diversity visa based on a single deadly terrorist attack are premature. Table 1Diversity Visa Admissions by ...

Adding Uzbeks to the Travel Ban Will Further Expose its Phony Criteria
Sayfullo Saipov, an Uzbek national, killed at least eight people with a truck in New York yesterday. Uzbekistan is a central Asian country north of Afghanistan ofalmost 30 million people—88 percent of whom are Muslim. President Trump did not include Uzbeks inhis travel ban released last month, but he is already sounding bellicose, writing that he will not allow ISIS to “enter our country” andthat he “ordered Homeland Security to step up our already Extreme Vetting Program,” a phrase which hesometimes uses as shorthand for the travel ban.But adding Uzbekistan to the travel ban would be unwise for a president whose...

The Halloween Terror Attack in New York: The Threat from Foreign-Born Terrorists
On Halloween, Uzbek-bornSayfullo Habibullaevic Saipov allegedly murdered eight people and injured 12 with a rented truck in New York City.   The details of the attack, the number of victims, and Saipov’s personal information could change over the next few days.  However, based on the information that we have so far, Saipov entered the United States in 2010 as a lawful permanent resident with a green card.  Heobtained his green card through theDiversity Immigrant Visa Program, which awards 50,000 green cards annually to those who enter the running from select countries.  Uzbekistan has not been a major source of terro...

Heritage Report Shows Refugees Are Not a Major Threat
ConclusionTheHeritage Backgrounder makes a valuable and interesting contribution to the debate over the future of the American refugee program. As a side effect, it shows just how small and manageable the refugee terrorist threat is. (Source: Cato-at-liberty)

Muslims Rapidly Adopt U.S. Social Values
Concerns about Muslim assimilation made news again this week when Donald Trumperroneouslyclaimed that U.S. Muslim neighbors failed to report the San Bernardino shooters. But this persistent idea that U.S. Muslims are not assimilating could not be more inaccurate. In fact, U.S. Muslims —81 percent of whom are immigrants or children of immigrants —are the most socially liberal and religiously tolerant in the world and becoming more so with each passing year.U.S. Muslims Are Adopting Americans ’ Liberal Social and Religious ViewsMore than 80 percent of Muslim Americans are immigrants or the children of immigrants, accor...

Modern Slavery, More Important than Who Built the White House
When Michelle Obama delivered her address at the Democratic National Convention (DNC) in Philadelphia, she created a stir when she cried out that America ’s story was “the story that has brought me to this stage tonight, the story of generations of people who felt the lash of bondage, the shame of servitude, the sting of segregation, but who kept on striving and hoping and doing what needed to be done so that today I wake up every morning in a ho use that was built by slaves.”That last line, “…I wake up every morning in a house that was built by slaves,” was the focus of much attention, with some conservative c...
