HHS: Notification of Enforcement Discretion for Telehealth Remote Communications During the COVID-19 Nationwide Public Health Emergency

Final rule from the Department of Health and Human Services announcing that it will use its discretion in how it applies the Privacy, Security, and Breach Notifications Rules under the Health Insurance Portability and Accountability Act of 1996 (HIPAA). In doing so, HHS will not impose penalties for noncompliance with the regulatory requirements under HIPAA rules against health care providers in connection with the good faith provision of telehealth during the COVID-19 pandemic. This rule went into effect on March 17, 2020.
