Does the Lack of Informed Consent Result in Increased Spinal Surgery Malpractice Litigation?

BACKGROUND CONTEXT: Medical practice litigation is an important issue in contemporary health care delivery. Predictive factors that have been identified to be associated with increased risk of litigation include severity of injury, gender of the physician and error in diagnosis. However, there is a paucity of literature investigating lack of informed consent in the spinal surgery malpractice environment.
