Judge: Lack Of 'Objective Findings' Is Not Sufficient Basis For Denial

SAN FRANCISCO - An ERISA-governed disability insurer that denied benefits to a claimant with fibromyalgia and chronic fatigue syndrome was not reasonably supported by the record, a California federal judge ruled Jan. 22. The judge said a lack of "objective findings" is not a sufficient basis for a benefit denial (Debra J. Eisner v. The Prudential Insurance Company of America, No. 12-cv-01238, N.D. Calif.; 2014 U.S. Dist. LEXIS 8554).
